Evo preko jednog domaćeg posrednika (o doticnoj firmi sam cua uglavno rijeci pohvale) san dobia ponudu za ugovor na STENA kompaniji, tankeri su u pitanju...
Ugovor me ve?že da za kompaniju radim 24mjeseca nakon moje "osposobljenosti" odnosno zavr??ene asistenture. To je sa moje strane ok, ali postoje stavke u ugovoru po kojima ja vračam sva svoja primanja u slučaju da prekinem ugovor iz BILOKOJEG razloga! Tako je otprilike moje tumačenje stavki... Znači u slučaju bolesti, nesreće itd također?
Evo stavit ću nekoliko stavki iz ugovora, pa bi zamolia iskusnije da mi to protumaće.
Dakle:
2. Study Duty
As part of the Trainee's duties under the Employment Contract, he shall attend to all Training diligently and apply the whole of his energies to the acquisition of the skills and knowledge taught or otherwise made available during the Training, and to the successful achievement of all work, tests and examinations set therein.
3. Course Fees:
The Employer will reimburse 100% of course fees on satisfactory completion of OOW trainee program inclusive of:
Certificate of Competency
Basic STCW 95
Advanced Merchant Navy Fire Fighting
Medical First Aid
Tanker Familiarisation
GMDSS (GOC)
Certificate of Proficiency & Survival Craft
4. Undertakings
Upon the Completion Date, the Trainee undertakes to continue in his employment with the Employer for a period of not less than 24 months from the Completion Date in no less a capacity of Junior Officer rank and applicable salary scale.
5. Refund of monies
5.1 The Trainee undertakes to reimburse to the Employer all Payments & Course Fees made to him if he ceases his employment with the Employer for whatever reason within 24 months of the Completion Date (except as mentioned in clause 5.2 below).
5.2 The Trainee shall not be liable to make any reimbursement to the Employer under this Agreement if the termination of his employment was as a result of dismissal by the Employer other than on grounds which the Employer became entitled to and did terminate his employment summarily.
5.3 If the Employer waives the repayment of all or part of the Payments and/or Course Fees, the Trainee shall pay any income or other tax payable as a result of the waiver and compensate the Employer in full on demand for any liability for such tax.
5.4 Any amounts payable by the Trainee to the Employer shall be paid within 2 weeks of any demand in writing from the Employer.
5.5 If the Trainee is for any reason indebted to the Employer for any amount the Trainee agrees that the Employer shall be entitled to make a deduction in or towards the discharge of that liability from his remuneration or any other money payable from the Employer to him.
6. Employment Contract
The Surety shall take all reasonable steps to ensure that the Trainee fulfils the obligations incumbent on a Trainee herein and undertakes to give the Trainee every encouragement and assistance to do so. By executing this agreement the Surety undertakes a joint and several liability along with the trainee to pay to the Company any sum payable in terms of clause 5 hereof.
7. Employment Contract
The Employment Contract shall remain effective in all respects except as expressly altered by this Agreement.
8. General
8.1 This Agreement contains the entire agreement between the parties in respect to its
subject matter and supersedes all previous agreements and understandings between
the parties and may not be modified except by the written consent of both parties.
8.2 The Employer shall be entitled to assign or transfer all its rights and powers and/or
Obligations under this Agreement.
8.3 If any term or provision in this Agreement shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law, that term or provision or part shall to that extent be deemed not to form part of this Agreement and the enforceability of the remainder of this Agreement shall not be effected.
8.4 No failure to exercise, or delay in exercising, on the part of any party hereto any right, power or privilege under this Agreement shall operate as a waiver, nor shall any single or partial exercise of any right, power or privilege preclude any other or further exercise of any other right, power or privilege. No waiver by the Employer shall be effective unless it is in writing. The rights and remedies of the Employer are cumulative and not exclusive of any rights or remedies provided by law.
8.5 The validity construction and performance of this Agreement shall be governed by English Law and the Parties shall submit to the non-exclusive jurisdiction of the Courts of England.
Moji upiti su najvi??e vezani za točku 5. "Refund of monies", i svih 5 stavki su mi poprilično nejasne.
U stavci 5.1 stoji da sam du?žan vratit sva primanja poslodavcu uključujući i novac utro??en u moju obuku ako iz BILOGOJEG razloga ne odradim 24 mjeseca na dotičnoj kompaniji.
Sad dolazi točka 5.2 u kojoj stoji da ja ("trainee") nisam du?žan vratit sredstva ukoliko dobijem otkaz od poslodavca:
"The Trainee shall not be liable to make any reimbursement to the Employer under this Agreement if the termination of his employment was as a result of dismissal by the Employer"
osim u slučaju da poslodavan ima zakonskog temelja da me otpusti:
"other than on grounds which the Employer became entitled to and did terminate his employment summarily."
Ono ??ta me interesira je jesu li ovakve stavke u ugovorima uobičajene, i u slučaju da nisam u mogučnosti nastavit ugovor na određeni period (nesreća,bolest itd.) jesam li du?žan refundirat sva primanja?
Događa li se u praksi kada da kompanija iskoristi te svoje "zakonske ovlasti" i pri kraju ugovora pomorca ostavi na cjedilu?
Kako mi iz kompanije tumače; njihove zakonske osnove za otpust su recimo sabota?ža koji radnik napravi da bi namjerno dobio otkaz... Naravno da nitko normalan ne bi napravio namjerno sabota?žu (ja se barem nadam), ali tko radi taj napravi sigurno i koju pogre??ku u svome radu, pa se bojim da bi se eventualni propusti koji se mogu dogodit radniku mogli protumačit kao nemar i gesta kojom uposlenik poku??ava dobit otkaz od strane poslodavca.
Pretpostavljam da se to ne događa, ali radi opreza i meni nejasnog ugovora osjećam potrebu da postavim to pitanje!
